COMMONS ACT 2006 POWICK COMMON NOTICE OF APPLICATION FOR CONSENT UNDER SECTION 38 OF THE COMMONS ACT 2006
WORCESTERSHIRE COUNTY COUNCIL has applied to the Secretary of State for Environment, Food and Rural Affairs for consent under section 38 of the Commons Act 2006. The Planning Inspectorate will decide the application on behalf of the Secretary of State for Environment, Food and Rural Affairs. The proposed works are: Temporary and permanent works in connection with the A4440 Worcester Southern Link Road Phase 4 adjacent to and between Powick Roundabout and Ketch roundabout including the following, of which items (i), (ii), (iv), (vii) and (viii) are the subject of the Section 38 application:
(i) Ground investigation in Powick Common parallel to the existing A4440 Temeside Way embankment for soils material sampling and water monitoring, including 10 no. trial excavations approximately 2m2, and 30 no. boreholes approximately 1m2. All ground investigation works temporarily fenced during investigation and backfilled on completion, with the exception of marked sampling tubes to remain protruding above ground for three years for water monitoring purposes in relation to the boreholes;
(ii) Six temporary trenches of 50m length x 2m width for Archaeological investigation in Powick Common to the south side of the existing A4440 Temeside Way embankment, temporarily fenced during investigation and backfilled on
(iii) Permanent widening on the south side of the existing embankment of the A4440 Temeside Way onto Powick Common between Powick Roundabout and Carrington Bridge, for an additional two lanes of carriageway including associated verges, embankments, slip roads, drainage ditches and livestock fencing [area of 1.90Ha];
(iv) Permanent access strip on Powick common to enable maintenance of drainage ditches described in (iii), and maintenance of viaduct described in (vi) [area of 0.93Ha];
(v) Permanent ramps for new combined cycle and footbridge at Hams Way in Powick Common to the west of Powick Roundabout, including maintenance access [area of 0.33Ha];
(vi) Permanent viaduct to carry the widened A4440 Temeside Way over Powick Common, alongside the existing Powick Common Viaduct [area of 0.19Ha];
(vii) Relocation within Powick Common of an existing electricity pylon on the south of the A4440 Temeside Way, including associated ground investigation, erection of temporary pylon and temporary cable support structures during relocation (noting the existing pylon is already
within Powick Common);
(viii) Temporary site compounds and working areas to facilitate undertaking the works described in (i) to (vii) above, and access for environmental mitigation works [area of 8.71Ha].
The total area of temporary and permanent works
within Powick Common is 12.06Ha.
