A MAN was given a community order after admitting assault, criminal damage and threatening behaviour at a Malvern shop.

Wayne Frankum, from Lower Chase Road, told a shop owner he would "kill him on the counter" if he told police after he pushed a display to the floor and damaged a sign.

Frankum appeared at Worcester Magistrates Court on Thursday, February 16, and also admitted being in breach of an earlier conditional discharge for another offence.

Prosecuting Kerry Lovegrove said the incident happened at Elgar Convenience Store at 6pm on Monday, January 30, and began when the manager, Mr Thurairajasingam (CORRECT) heard a smashing sound outside, and found the shop's Coffee Station sign on the floor with a hole in.

The manager went outside and saw the 25-year-old next to the broken sign.

When he tried to question Frankum, asking him what had happened, Frankum began walking away but he then suddenly pushed Mr Thurairajasingam with both hands.

When the manager tried to escape by going back into the store and getting behind the counter, Frankum followed and continued to be threatening inside, pushing a chewing gum display to the floor and throwing a charity box.

Frankum then said "this is my country" and told Mr Thurairajasingam that if he told police he would "kill him on the counter".

Joanne Outhwaite, defending, said Frankum's problem was drink, saying his attitude changes when he had consumed alcohol as he done before this incident.

She added that Frankum had attempted to turn his life around by self referring himself to alcohol and drug recovery service Swanswell, and was on medication for his mental health issues.

Magistrates gave Frankum a community order of 12 months with a rehabilitation requirement.

He was also fined £95 for breaching the conditional discharge, and ordered to pay £100 compensation to the victim, £400 compensation for the criminal damage, court costs of £50, and a victim surcharge of £85 - a total of £635.
