A DEPRESSED woman tested four times the legal drink drive limit the morning afternoon after consuming wine, a court heard.

Despite the high roadside reading, which cannot be used as evidence in court, Barbara Jones was banned from driving for 32 months at Worcester Magistrates Court yesterday after admitted failing to provide a specimen of breath.

Emma Lile, prosecuting, said police were called to a petrol station on the A46 Evesham bypass following reports of a lady being unwell.

"The officers could smell alcohol on her breath," she said.

Miss Lile said following eight failed attempts to provide a roadside specimen, the 57-year-old, of Phillips Road in Broadway, gave a reading of 140mcg of alcohol per 100ml breath - the legal limit being 35mcg.

She said after providing the reading, Jones failed to give an official breath specimen at the police station.

Chris Hilton, defending, said: "She has not consumed any alcohol that day or lunchtime, she had consumed alcohol the previous evening running into the small hours."

Mr Hilton said Jones had her last drink at about 2am on Sunday, August 26. Police were called at 12.45pm that day.

"She had not eaten the night before, so effectively her diet the night before had been a liquid diet of wine," he added.

"She's not drunk alcohol since then."

Mr Hilton said Jones had been depressed because of a family breakdown, which had been resolved following the incident.

As well as the ban she must pay a £500 fine and £60 costs.
