MUM-OF-TWO Tammy Hart's honesty got her arrested, magistrates heard.

Having been banned from driving after totting up too many points, the 25-year-old was driven on January 20 by a friend from her home on Grasmere Close, Kidderminster, to see her husband, a prisoner at Gloucester jail.

While she was telling him their relationship was over, in the visiting area, her friend, the driver, was arrested and taken into custody for a matter outstanding against him.

Needing to pick up her two children - aged eight and three - Hart explained to police that with her driver behind bars she had no choice but to take the wheel, despite being banned until October.

But after driving just a few yards, officers stopped her and arrested her for driving while disqualified.

They also noticed the car had no insurance and also charged her for that, prosecutor Joanna Harrison told Gloucester Magistrates Court.

She said Hart, a business studies student, had been disqualified for 18 months under the totting up system last April.

The ban was set to expire in October.

Hart, she explained, was also the subject of a 12-month conditional discharge. This was imposed for a common assault after a dispute with neighbours - at the time of these latest offences.

This breach was also admitted.

Fergus Maxwell, defending, told the court: "She was visiting HMP Gloucester to see her husband in order to tell him the relationship was over.

"She was driven down by a friend. Unfortunately, while she was visiting he was arrested outside.

"She told the police officers she was a disqualified driver, but explained she needed to get back to Kidderminster to collect her children. She was in a very difficult position."

Magistrates bailed Hart on the condition she does not drive until March 30 when she will be back at court for pre-sentence reports.

Mr Maxwell made a successful application to cancel an existing bail condition, which stated Hart was also not allowed to be a front-seat passenger, saying: "It appears she breached that this morning - I gave her a lift down and I have a two-seater car."
