A MARRIED waiter raped a 19-year-old girl at the restaurant where he had been working, a jury at Worcester Crown Court was told.

She went to Pundits in Old Street, Upton-upon-Severn, to try and obtain a lift to Malvern to see her former boyfriend about their relationship problems.

But when she failed, she stayed at the restaurant chatting to staff.

Prosecutor Antonie Muller alleged that Abdal Miah, who had worked there for a month, saw she needed "a shoulder to cry on" and took advantage.

He claimed Miah, who had never met her before, attacked her in his bedroom before letting her out to make her own way home at 3am.

On her return, she woke up her parents and became hysterical. A doctor found fresh bruises on the teenager's breasts.

Mr Muller said Miah hid some of the bedding and fled the restaurant through a back door as police arrived.

Miah, aged 27, of Hemming Way, Evesham, denies rape on Monday, October 21 last year.

He told police they had consensual sex after she came to his room as he was changing to go home.

He claimed she accused another member of staff of coming into the bedroom - while Miah was downstairs - and touching her. He said it had upset her and he had begged her to forgive his colleague.

Mr Muller said the girl had wanted to see her boyfriend about their relationship following a text message he sent her. She was upset at not getting a lift.

"He said she came on to him, jumped into his bed, whipped off her clothes and had unprotected sex with him," said Mr Muller.

The girl, who sobbed throughout her evidence given on a video link, said she had been to pubs before getting to the restaurant and wanted to talk about problems with her boyfriend.

She claimed Miah asked her to go upstairs for a cigarette, which she smoked while sitting on his bed. He massaged her shoulders before allegedly pushing her down.

"He held me down with his hands on my chest," she said. "I was crying and tried to push him off. When someone's crying, you don't do that."

She said afterwards another man entered the room and asked her if she had enjoyed it. She pushed him out of the way and left.

Defence counsel Robert Cowley suggested that Miah got under the bedclothes because he felt cold and the girl followed him voluntarily.
