A LONG-running argument over a pub beer garden in Alcester is being taken to the High Court.
Neighbours from Henley Street are taking their fight to court because Stratford Council failed to act over the Holly Bush garden.
Two years ago, the landlord had a garden to the rear of the pub landscaped.
The complainants claim it had only ever been used as a private garden so planning permission should have been sought for its use as a beer garden
They felt there had been a human rights breach because they have a right to a home-life free of such things as noise nuisance.
The district council expressed sympathy but said it did not regard there had been a material change of use and would not take action.
The district council is talking with its Legal Services Unit prior to the hearing.
