A motorist cleared of causing his girlfriend's death by dangerous driving will not be prosecuted for having two defective tyres.

Worcester Crown Court was told that the tyres on James Fisher's Metro had not contributed to an accident in which 16-year-old Katherine Davies died.

James McCracken, prosecuting, said the Crown had reviewed its position after Fisher's acquittal and was offering no evidence.

Deputy Judge Thomas Dillon QC dismissed the tyre charges.

Fisher, aged 19, of Frenchlands, Lower Broadheath, near Worcester, was cleared of dangerous driving on Wednesday this week, but found guilty of the lesser charge of careless driving and fined £500 with a two-year driving ban.

His car went out-of-control on the Martley to Great Witley road on Friday, September 22, last year and overturned.

Miss Davies of Downs Manor, Bromyard Downs, Bromyard, died instantly from a broken neck.

Fisher had also been charged with the tyre offences but they could not be dealt with at the end of the trial because of administrative problems.
