THE trial of a man accused of causing the death of a young boy by reversing over him on a driveway has been postponed after a key defence witness went missing because he was out fishing.
Patrick O' Malley, aged four, died near his home at Upper Rissington last summer and Andrew Smith, 44, of Townsend Avenue, Keyham, Plymouth, appeared at Gloucester Crown Court on January 25 to answer charges of driving without due care and attention whilst over the drink-drive limit.
But the trial had to be postponed when forensic scientist John Ackrill failed to turn up. The court heard he had gone fishing after his office said he would not be needed that day. The case was adjourned until February 21.
