SIR – With reference to the headline story of June 7, ‘Don’t Be Fooled!’ We are told that no legal action can be taken against those circulating these bags.
I cannot understand why not.
Under Section 2 of the fraud act 2006, Fraud by false representation is defined when “Any representation as to fact or law, express or implied which is known to be false or misleading is made”.
What is written on the bags is certainly designed to deceive and is misleading.
For an offence to be proved under the act, the person must have acted dishonestly, with the intent of making gain for themselves or anyone else.
And this is obviously the intention or inflicting a loss or the risk of a loss on another. In this case the “real air ambulance service”
would be the losers!
