A MAN who shouted “come out monkey boy, I want to fight you” to his wife’s new partner while brandishing a five inch kitchen knife is almost certain to face custody after magistrates decided their powers were not sufficient.

Anthony Brophy, who lives next door to his wife in Carlisle Road, Ronkswood, Worcester, had taken a disliking to her partner, Worcester Magistrates Court was told.

Brophy, aged 43, pleaded guilty to possessing a knife in public and a section four public order offence.

Appearing in court last month, Magistrates decided to adjourned for a pre sentence report but did not rule out send the case to crown court.

Mark Johnson, prosecuting, said it was an “unusual” domestic situation with Brophy living nextdoor his wife Tina and the couple’s children living in both properties.

Mrs Brophy’s new partner, Richard Francis, and Brophy had an argument on Wednesday, April 20 which culminated in Brophy making the threats in the early hours of Friday, April 22.

Mr Johnson said although no direct threats were made with the knife, the fact Brophy was holding a knife while telling Mr Francis he wanted a fight made it “dangerous circumstances”.

Magistrates, who can hand out sentences of up to six months per offence equalling a total of one year, decided they did not have sufficient powers to deal with Brophy for the knife matter.

Brophy was bailed to attend Worcester Crown Court on Tuesday, August 30 on the condition he doesn’t contact Richard Francis or go to his wife’s house.
