A WOMAN who shouted racist abuse at takeaway staff and hit a man in an unprovoked attack has escaped going to prison.

Kiya Brandrick, aged 23, of Victoria Avenue, off London Road, Worcester, pleaded guilty at Worcester Magistrates Court to racially aggravated harassment, assault by beating and obstructing a policeman.

Sarah Stock, prosecuting, said Brandrick entered the Golden Fortune Chinese Takeaway in Gresham Road, Dines Green, Worcester, at about 5.30pm on New Year’s Eve and repeatedly made racist comments to Annie Ung.

Miss Ung sister, Mui, came to the counter to ask what was wrong. They initially refused to serve Brandrick, who continued to be aggressive before leaning over the counter.

They took her order but she lit a cigarette and other members of Miss Ung’s family asked Brandrick to leave.

She blew smoke in Miss Ung’s face and threw fish and chip papers on the floor before threatening to “stab you up” and leaving.

Police were called and as an officer arrested Brandrick, she was “aggressive and hostile”.

A second officer was called and Brandrick was restrained on the ground, at which point she kicked out, striking him.

Later that evening, police received a call from Sam Martin to report an assault which happened at about 4.30pm while he was walking with his mother along Gresham Road.

Mr Martin, aged 18, was approached by Brandrick who asked for his mother’s crutches. When they refused, the defendant made repeated “aggressive and drunk” demands.

Brandrick asked for Mr Martin’s hat and as he walked off Brandrick punched him in the face, causing a cut lip and swelling. The defendant then became involved in an altercation with Mr Martin’s mother as she attemped to calm Brandrick.

Ruth Edwards, defending, said her client was “appalled” by her behaviour but had little recollection of the afternoon’s events because of a combination of alcohol and drugs.

She said: “Whilst excess of alcohol she had consumed on that day provides an explanation, [Brandrick] doesn’t put it forward as an excuse.

“Clearly, there are issues that need to be dealt with and in particular issues behind why she drinks to excess and why she takes illicit substances.

She added Brandrick was “disgusted” by the words she had used.

Ms Edwards said Brandrick was currently “sofa surfing” and illness and various problems meant she was currently not in work.

She could not function without alcohol and used drugs to mask her “extreme self-deprication”.

She was motivated to get help for her alcohol and substance abuse.

She was sentenced to eight weeks custody for assaulting Mr Martin and three weeks for resisting arrest, suspended for 18 months. She was fined £400 for using racist language and ordered to pay compensation of £100 to Mr Martin and £250 each to Annie and Mui Ung.

Brandrick was also ordered to pay £85 costs and £15 victim surcharge. She will also undergo a supervision requirement for 18 months and a six-month drug rehabilitation requirement.
