TWO workers from a company which claims it is collecting funds on behalf of the air ambulance have been released without charge after Trading Standards said they were not breaking the law.

Their release has prompted the Midlands Air Ambulance charity to warn people not to be fooled into thinking that the collections are anything to do with them. As reported in the Worcester News on Saturday, two Lithuanian men were arrested on suspicion of fraud and theft after being caught on camera collecting bags in Kempsey, near Worcester.

A spokesman from West Mercia Police said they had liaised with Trading Standards officers at Worcestershire County Council who said no further action should be taken.

The bags and accompanying leaflets, which have been distributed across the county, have Air Ambulance Service printed on them in bold type and claim to be “working to towards providing financial assistance to cover or reduce the cost of ground and air ambulance medical transportation”.

People are directed to airambulanceservice.org.uk – which is unavailable and are urged to call or text premium rate phone numbers for membership information.

However, in the small print it says the company is collecting commercially to make profit and is not associated with any local helicopter emergency service.

Jamie Colley, fair trading officer at the county council’s regulatory services, refused to comment on individual cases but said companies which collect clothing to sell for profit are not doing anything illegal.

He added: “They have to be clear on the collection bags and not mislead people into thinking they are a charity. If they are misleading, then it is in breach of our rules.

“If people think information is misleading then they should contact Consumer Direct on 08454 040506.

"We don’t want to deter people from making complaints.”

Kempsey parish councillor David Harrison, who is also regional fund-raising co-ordinator for the Midlands Air Ambulance charity, said: “It makes you think, what is the point in trying to stop these people?

“All we can do is to continue to warn people.”

Concerned residents in Pershore have contacted the Worcester News about Air Ambulance Service collections taking place in the town tomorrow.

Our research suggests this company is operating all over the country and we have found no evidence of any local air ambulance services receiving funds from them.

A spokesman from Midlands Air Ambulance said anyone who falsely claimed to collect of behalf of the air ambulance undermined their charity’s relation with the public.

“We wish to clarify that these collectors are in no way affiliated with the charity and, as far as we can ascertain, are misleading the public with their claims and adopted identity,” he said.

“We would like it to be clamped down on.”

A spokesman from West Mercia Police said: “We are still encouraging people who notice suspicious activity in their area to report it to us by calling 0300 3333000 or Crimestoppers on 0800 555111.”

Surely these men are acting illegally. Using the Air Ambulance name and quoting a website that is unavailable is deliberately misleading the public and is fraud.

In the past when I have left bags outside our house for collection they have been there for days, so I gave up and started using the bags that come through our door to bag stuff up and take to the charity shops of our choice.
At least, that way, I know any monies raised will go to the charity of my choice.

That's a good shout Logowizard, but it's still a sad state of affairs that these scumbags can take advantage of human compassion in such a way and get away with it due to a technicality.

The clear bit being the air ambulance reference the misleading being the small print, how is that not breaching their rules?
I wonder what Trading Standards would find if they investigated this company fully and found out where their money was going? Too much to expect them to protect the public these days though, it's all red tape and small print.
Well done to WN and James Savage for warning us about this dubious group of individuals and at least trying to do something about it. These companies obviously know all the loop holes in the laws and exploit them to the full, as the initial reaction from the 'collector'..'commer

its such a shame as people will now be wary of giving to genuine collectors... they should have been charged for fraud/ obtaing items by deception!! In future i would rather take items directly to charity shops... just shows what this country is like though to be fair, we are too lenient

As per Sir Smeg, Trading Standards have been under immense financial pressure for some time, and with the CSR really kicking in they have hardly the time to investigate anything now. This is a shame as they are paid for with our council tax. They can only do what they can do!

Donations of items to raise funds for the Air Ambulance can be made to Daisychain Benevolent Fund in St Johns (also in Evesham I believe) as any money they raise is split between Midlands Air Ambulance and Noah's Ark Trust (a worthy charity to support kids through bereavement). Any donations of cash I'm sure can be made direct to the air ambulance themselves.

With so many charity shops around today, and quite a few that do collection by arrangement, I much prefer to give direct, which also cuts down on their costs I'm sure.

We complained about a double glazing advert put through the letterbox. The company claimed it was celebrating its 10 year anniversary.

Yet a free search at Companies' House indicated the company was only set up a couple of months earlier.

By the way, it would seem from these comments that Jamie Colley "fair trading officer at the county council’s regulatory services" (what a title), is out of touch with the public's views on this matter.

Clearly the comment responses to this article unanimously disagree with the views he holds and it must therefore be questioned whether, given his judgement, he is suitable for the position he holds?
