A MAN who attacked his former friend with a fire extinguisher told police he was paralytic after drinking wine and vodka.
Daniel McIntyre was in the Bush Inn, St John’s, Worcester, when Del Smith entered on Saturday, January 14.
About 15 minutes later, Smith walked towards Mr McIntyre and the next thing he remembered was being covered in a white substance, said Kerry Lovegrove, prosecuting at Worcester Magistrates Court.
He then saw Smith leaving the pub holding a fire extinguisher. Mr McIntyre said his £400 mobile phone was damaged during the incident.
Miss Lovegrove said Smith told police that he had been drinking vodka and wine and was paralytic.
He could not remember anything about the incident.
Smith, aged 22, of Gresham Road, Dines Green, Worcester, admitted charges of assault by beating and criminal damage, as well as failing to report to Worcester police station on Friday, February 3.
Andy Childs, defending, said Smith and Mr McIntyre had been friends when they were younger but had fallen out.
“He went into the pub and saw him by chance,” said Mr Childs. “He had had too much to drink, saw the fire extinguisher and thought it would be amusing in some way.
“He realises what he did was utterly stupid and he deeply regrets it.”
Magistrates issued Smith with a conditional discharge on the charges of assault and criminal damage and ordered him to pay £100 compensation for the damage to Mr McIntyre’s phone and £225.20 for costs incurred by the pub.
He was also fined £100 for the Bail Act offence.
