NOTICE OF CONFIRMATION OF AN ORDER HIGHWAYS ACT 1980. MALVERN HILLS DISTRICT COUNCIL
THE MALVERN HILLS DISTRICT COUNCIL (PUBLIC FOOTPATH NOS. MT-695 (PART), MT-696 (PARTS), MT-699 (PARTS) MT-700 AND MT-701 (PART), PARISH OF MARTLEY) PUBLIC PATH DIVERSION ORDER 2016
On 27th March 2017 Malvern Hills District Council confirmed the above order made under section 119 of the Highways Act 1980. The effect of the Order as confirmed is to divert the public footpaths running from:
(A-B-C) Point A, Ordnance Survey ("OS") grid reference SO75106,59974, in a south-south-westerly direction for 8 metres to point B, OS grid reference SO75105,59965, then continuing in a south-south-easterly direction for 29 metres to point C, OS grid reference SO75119,59941
(D-E) Point D, OS grid reference SO75140, 59899, a point on Ryecroft Way, in a south-south-easterly direction for 65 metres to point E, OS grid reference
SO75168,59840
(E-F) Point E, OS grid reference SO75168,59840, in a south-south-easterly direction for 7 metres to point F, OS grid reference SO75172,59834, a point at the junction of public footpaths MT-696 and MT-701
(F-G) Point F, OS grid reference SO75172,59834, in a south-south-easterly direction for 2 metres to point G, OS grid reference SO75173,59832
(H-E) Point H, OS grid reference SO75133,59824, in an east-north-easterly direction for 37 metres to point E, OS grid reference SO75168,59840, a point at the junction of public footpaths MT-699 and MT-700
(F-P) Point F, OS grid reference SO75172,59834, a point at the junction of public footpaths MT-696 and MT-701, in an east-north-easterly direction for 112 metres to point P, OS grid reference SO75272,59885
(Q-S) Point Q, OS grid reference SO75279,59893, in a north-north-easterly direction for 55 metres to point S, OS grid reference SO75301,59943.
These footpaths are diverted to new lines as follows:
(A-C) A length of public footpath running from point A, OS grid reference SO75106,59974, in a south-south-easterly direction for 36 metres to point C, OS grid reference SO75119,59941. The width of the path is 2 metres.
(D-J) A length of public footpath running from point D, OS grid reference SO75140,59899, a point on Ryecroft Way, in a south-westerly then south-south-easterly direction for 72 metres to point J, OS grid reference SO75166,59834. The width of the path is 2 metres.
(H-J-K-L-M-N-P) A length of public footpath running from point H, OS grid reference SO75133,59824, in an east-north-easterly direction for 34 metres to point J,
5075166.59834, then continuing in an east-north-easterly direction for 3 metres to point K, OS grid reference SO75168,59835, then continuing in an east-north-easterly direction for 33 metres to point L, OS grid reference SO75196,59847, then continuing in an east south-easterly direction crossing Ryecroft Way for 7 metres to point M, OS grid reference SO75206,59847, then continuing in a north-easterly direction for 47 metres on the footway adjacent to Ryecroft Way to point N, OS grid reference SO75244,59874, then continuing in an east-south-easterly turning east-north-easterly direction for 32 metres to point P, OS grid reference SO75272,59885.The width of the path is 2 metres.

(K-G) A length of public footpath running from point K, OS grid reference
5075168.59835, in a south- easterly direction for 6 metres to point G, OS grid reference SO75173,59832.The width of the path is 2 metres.

(Q-R-S) A length of public footpath running from point Q, OS grid reference SO75279,59893, in a north-easterly direction for 22 metres to point R, OS grid reference SO75291,59911, then continuing in a northerly turning north-easterly direction for 36 metres to point S, SO75301,59943. The width of the path is 2 metres.
The effect of the diversion order is shown on the order map.
A copy of the order as confirmed and the order map have been placed and may be seen free of charge at The Library, Graham Road, Malvern, Worcestershire, WR14 2HH, between 9.00 am and 5.30pm on Mondays, Thursdays, Fridays and Saturdays and between 9.00am and 8.00 pm on Tuesdays and Wednesdays. Copies of the Order and map may be bought there at the price of £1.
The order comes into force as from 24th April 2017, but if any person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of that Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 7th April 2017, make an application to the High Court.
