A DRUNK driver has been given a curfew after admitting driving while disqualified.
Daniel Hallissey pleaded guilty to driving a vehicle when his alcohol level was above the legal limit and driving whilst disqualified when he appeared at Worcester Magistrates Court.
Shafquat Reaz, prosecuting, said Hallissey, who was driving a Ford Mondeo, was stopped by police on the Droitwich section of the M5 on April 9.
After police spoke to the 35-year-old, of Waterside Park, Offerton Lane, Worcester, he was suspected of drink driving, so was taken to Worcester Police Station where a sample showed he had 43 mcg in alcohol in 100ml of breath, above the legal limit of 35mcg.
Nigel Ford, defending, said the matter was a straightforward one and he had warned his client he would be getting a lengthy ban, having already been caught driving whilst disqualified earlier this year.
Magistrates then asked why the father-of-four was driving when he would have known he was disqualified.
Mr Ford replied: “It was circumstances he found himself in.
“I know he doesn’t want me to come up with a long winded excuse.
“He knows he should not have done it.”
After 10 minute deliberation magistrates returned and warned if Hallissey was found driving on any public road again, he could expect a custodial sentence.
Hallissey was given a three year driving ban and a 16 week electronically monitored curfew in place nightly between the hours of 7pm and 7am.
Hallissey was also fined £80, and ordered to pay costs of £135 and a victim surcharge of £95.
Magistrates accepted an offer for the total of £310 to be paid at a rate of £10 a fortnight.
The case was heard on Thursday.
