The attacker, jailed for two years and nine months at Worcester Crown Court yesterday, faces being deported to his native Poland following the attack in Warndon Villages, Worcester on July 22 last year.

David Phillips took photographs of the defendant having heard the victim's screams near Grosmont Avenue. Simon Phillips, who prosecuted the case, said Mr Phillips heard her shouting 'help! Help!'

The judge who jailed Pieczykolan described him as 'loitering' near woodland before the attack.

When David Phillips asked Pieczykolan what he was doing he swore and said 'you people are idiots' before walking off in the direction of a wooded area.

Recorder Christopher Millington QC described how the defendant 'grimaced' when his photograph was taken and said it was later used to 'identify you being the attacker'.

During the attack the defendant had told the mum 'no-one can hear you' but he was wrong and it was evidence from the men who came to her aid who helped secure Pieczykolan's conviction.

The 'stocky' 33-year-old admitted attacking the 'petite' woman at around 4pm.

The married woman was on the phone to a friend near Grosmont Avenue, Warndon Villages, when she saw the defendant lying on the ground. He asked her for the time which she thought was 'odd' as he had a mobile phone of his own and she began to feel 'uneasy'. Pieczykolan got up and walked in the same direction, snatching her phone off her and hitting over the head with it before commencing the sexual assault.

The married victim, who cannot be identified, also hit Pieczykolan with her umbrella but 'that made no impression' before he pulled her clothing down, scratching her chest and face with his fingernails.

"She continued to scream for help but he replied 'no-one can hear you' or words to that effect" said Mr Phillips.
