A DAD-of-two who threw his girlfriend up a wall was been warned he could still be jailed.

Justin Rushgrove admitted three charges of assaulting a person thereby occasioning them actual bodily harm, criminal damage to property and common assault when he appeared at Worcester Magistrates Court.

The 44-year-old was in a relationship with his girlfriend for eight months, and prosecutor Sumreen Asfar described it as “volatile and toxic”, the court heard.

The prosecutor said the victim went to Rushgrove’s home in The Green, Hallow, on October 15 both drinking a large amount of alcohol.

Rushgrove threw her up the wall “five or six times”, grabbed her around the throat and covered her mouth to stop her from screaming.

Miss Asfar said he threw the victim’s belongings outside the house, breaking her mobile phone, before the victim shouted “help” and neighbours came out - one witnessing Rushgrove pushing the victim out the house.

The prosecutor said no complaint was made to the police by the victim or neighbours, but four months later a second incident took place.

“On this occasion, the defendant grabbed the victim by the neck and shouted in her face,” Miss Asfar said.

Miss Asfar said the victim tried to get away from Rushgrove before he knelt on her, causing pain in her back.

This incident led to police being called, who later arrested Rushgrove.

She had injuries to her throat, bruising on her shoulder, back and right arm, and suffered headaches from being pushed up the wall.

Belinda Ariss, defending, said Rushgrove had committed the offences having drunk a lot of alcohol, adding he had addressed this now.

“He didn’t like himself, he didn’t like the way he behaved," Mrs Ariss said.

Mrs Ariss said the October incident came after a huge argument in which the victim had refused to leave and it escalated.

Mrs Ariss said her client disputed that he had put his hands around the victim’s throat, those injuries he said being caused in the "wrestling" to get her out.

'All options' available to magistrates who will sentence Justin Rushgrove

Chairman of the magistrates bench Judith Hulland said they had decided the matter could be sentenced by magistrates, ordering a pre-sentence report be completed on Rushgrove.

The chairman added "all options" on sentencing will be available to magistrates.

Rushgrove is be sentenced at Redditch Magistrates Court on July 11.
