A FAMILIAR face has made a return to city courts after abusing a police officer.

Jack Payne, who has more than 20 previous convictions, admitted breaching a criminal behaviour order (CBO) when he appeared at Worcester Magistrates Court on Thursday, (July 7).

Melanie Winterflood, prosecuting, said Payne had been abusive towards the officer while drunk in a public place in Worcester.

This was all prohibited by the order that is placed on only the most serious and persistent offenders.

The prosecutor explained Payne had been abusive to PC Burgees after being arrested for an alleged assault - Payne later released without charge for that offence.

Barry Newton, defending, said Payne had taken offense to being arrested, but his client accepted he shouldn’t have been abusive.

He said Payne was on post-sentence supervision after previously being jailed, and was complying with that.

“The offence happened on June 3 (this year) – there have been no issues since," Mr Newton said.

“It is a minor breach, a brief incident. The words used bring him to the court.”

When the court clerk said Payne, of All Saints Road, Worcester, owed more than £4,000 to the courts Payne interrupted and began arguing that much of it had been wiped off when he had been sent to prison.

The court clerk said the fines “could now be in the hands of bailiffs”, adding the 26-year-old would need to look into this.

After deliberation chairman of the magistrates bench, Martin Soble, said: “You know breaching an order of the court is not taken lightly.

“You were drunk and you did kick off (at the officer) – if that didn’t happen we would not be here now.”

 

Magistrates say they hope to not see Jack Payne back in court again

 

The chairman said as Payne had been following the terms of the post sentence supervision “quite well” magistrates did not want to interfere with that.

Payne was fined £80, ordered to pay a victim surcharge of £34 and costs of £185, with it agreed he should pay the total of £299 at a rate of £50 a month.

The chairman added they hopefully would not see Payne in court again.
