A 28-YEAR-old woman has avoided a driving ban despite being caught being in charge of a vehicle when her alcohol level was above the legal limit. 

Sophia Carini-Morgan, of Langland Avenue, Malvern, had originally denied the offence but changed her plea to guilty before a scheduled trial. 

Worcester Magistrates Court heard Carini-Morgan had committed the offence by being in charge of a Renault Clio in Windermere Drive, Warndon Villages, when the alcohol in her breath was 68mcg in 100ml of breath - above the legal limit of 35mcg.

The offence took place on February 26 this year.

Carini-Morgan, previously of Clayfield Drive, Malvern, was given 10 penalty points. 

Martin Soble, chairman of the magistrates bench, explained to Carini-Morgan that because she had a clean driving licence it meant she had not reached 12 when she would become a totter, so she wouldn't be banned from driving.

But the chairman warned her if she did anything to gain points, including speeding, in the next three years she would be banned. 

Carini-Morgan was fined £360, told to pay court costs of £250 and victim surcharge of £144. 

The defendant was told the total, £754, was due to be paid in full within 28 days but she could contact the fines collection office to arrange for the amount to be paid in instalments.
