A DRIVING instructor accused of indecently assaulting a teenage pupil is to stand trial for a second time on Wednesday, October 22.
Earlier this month, Stephen Burge's first trial was abruptly halted on legal grounds in the final stages.
Yesterday, prosecutor Paul Grumbar announced at Gloucester Crown Court that the Crown was seeking a retrial of the charge.
Judge Michael Roach said the case would be retried either in Bristol or Swindon Crown Court on October 22.
Asked by defence barrister Robert Duval if he would preside over the retrial, the judge said he would if it was held at Bristol, where he will be sitting that week.
Burge, a father of three, of Carwardine Fields, Abbeymead, Gloucester, has denied indecently assaulting the young Worcester woman at his home after she had failed her driving test earlier on that day, January 17.
