A CAR crash victim is not to face trial on a charge of intimidating a witness in an assault case.
Dolphus Boswell, 36, of Lickhill Road, Stourport, pleaded not guilty last month to intimidating Stephen Scarrett by waving his fist at him.
But prosecutor Pardeep Tiwana offered no evidence against him at Worcester Crown Court and revealed he had suffered a broken neck in a pile-up.
He said the alleged intimidation was not the most serious kind and Boswell was having spinal surgery and would be confined to bed for a considerable time. Judge Michael Mott ordered a not guilty verdict to be recorded.
