A DISABLED Redditch man who killed the brother of a Hollywood star in a road rage attack in 2004 has had his jail term cut by the Court of Appeal.
Eugene Warwood, 55, of Salop Road, was sentenced to three-and-a-half years in jail at Birmingham Crown Court last year after he pleaded guilty to the manslaughter of retired journalist Edward Trimmer, the 78-year-old brother of actress Deborah Kerr.
But last week, Appeal Court judge Lord Justice Keene cut the term by a year, ruling it was "manifestly excessive."
Warwood had punched Mr Trimmer, who was from King's Norton, outside a Birmingham post office in 2004, shattering his jaw. Mr Trimmer died in hospital later that day of a brain haemorrhage.
Lord Justice Keene said Warwood had shown "genuine remorse", and the incident had had a marked effect on him and his family.
He said there were aggravating factors in the case including the fact the victim was an elderly man and Warwood did not render any assistance.
"However, there is Warwood's own age to consider, his guilty plea and the fact that the offence was out of character," he said.
"Having anxiously considered the matter, and having regard to Warwood's physical condition, his guilty plea and the fact the consequences outstripped the intention, we are driven to conclude the sentence cannot stand."
