A MAN who breached his criminal anti-social behaviour order for the sixth time has been told by a judge to start behaving or spend the rest of his life behind bars.

Jake Dinsdale was given a Crasbo in December 2009 which prohibits him from drinking, being drunk, or using foul and abusive language in public.

He is also excluded from parts of the Dines Green area of Worcester where he lives.

Colin Heald, prosecuting at Worcester Magistrates Court, said the 20-year-old, of Howard Road, Dines Green, was seen by a community support officer drinking in the St John in Bewardine churchyard in St John’s on September 15.

Dinsdale was holding a plastic cup but told the CSO he was drinking apple juice.

Mr Heald said: “The officer deduced it was not apple juice and could clearly smell alcohol on the defendant’s breath.”

Police arrived and saw Dinsdale holding an open bottle of cider then arrested him for being in breach of his Crasbo.

Mark Turnbull, defending, said each time Dinsdale has breached his order he has been given a custodial sentence which does not seem to work.

In July we reported how Dinsdale was given 16 weeks custody for threatening to rip a CSO’s head off.

Mr Turnbull said: “Custody doesn’t seem to be working.

“He recognises his alcohol consumption needs to reduce. A community order may be an option as custody has had little effect. Dinsdale is quite frank about his ability to do unpaid work or a curfew.

“By his own admission he needs to grow up. He is drifting and has no purpose.”

District judge Nana Lawrence said it was up to the court to decide what sentence is appropriate.

He said: “This is the sixth breach. It is not a matter for him to choose how the court punishes him. What reasons has he got for not being able to complete a curfew? He wants to go out and get drunk?

“If you misbehave the court makes an order and you need to obey that order. You can’t say ‘That is my lifestyle and I’m going to carry on’.”

Dinsdale was given a six-month curfew order from 7pm to 7am which will be electronically tagged.

Mr Lawrence said: “If you breach this order, as certain as night follows day, you will go to prison. Behave, or you are looking at a life behind bars.”
