The 28-year-old of Worboys Road, St John's, Worcester pleaded guilty to both offences which happened between November 15, 2019 and March 15, 2020.

In total £500 in cash was seized from Waller by officers. The defendant entered the dock with his bag already packed in anticipation of a custodial sentence being imposed.

Andrew Baker, prosecuting the case over live videolink, said the pleas entered were acceptable to the Crown but that he anticipated that there would be an application from the defence to adjourn sentence so a pre-sentence report could be prepared by the probation service.

Adam Western, defending, made the application to adjourn for this report. He added: "The offences are almost two years old. There are convictions against him but for cannabis only - possession of cannabis only. This is the first time he has faced the prospect of a prison sentence."

Mr Western explained that he had had his instructing solicitors unload references about 'this young man', In his submission, he said they provided evidence that he was 'a different individual to the one who committed these offences'.

"It may well be that the contents of the pre-sentence report do more than afford him some mitigation as to the length of the sentence but it may afford him such exceptional mitigation that would entitle the court to consider a sentence other than immediate custody" said Mr Western.

Granting the adjournment, Recorder Kevin Hegarty QC said Waller 'should have a report'.

"He's on the cusp of his first custodial sentence" said Recorder Hegarty. He added: "The court should look at all the details before reaching any conclusion as to how this will be dealt with."

He therefore granted a six week adjournment until April 26. The judge also urged Waller to co-operate with the probation service in the meantime so they could prepare a report 'detailing your background and your more recent progress in turning your life around as suggested in the references that have been uploaded onto the system'.

"The fact I'm adjourning should not give any comfort as to how you're going to be dealt with on the next occasion - it's no indication whatsoever. It is purely to inform the judge on the next occasion" he warned.

Recorder Hegarty made it a condition of Waller's bail that he co-operate with probation in the preparation of that report.

"If you do not surrender to bail on April 26 without reasonable excuse then you will commit a criminal offence which will attract its own penalty," he said.
